Terms of Service

1. Acceptance

By accessing or using Nalanda Archives ("the Platform"), operated by Nalanda Archives ("we", "us", "our"), you agree to these Terms of Service. If you are a parent or guardian creating an account for a child, you accept these terms on their behalf. If you do not agree to these Terms, you must discontinue use of the Platform immediately.

2. Eligibility & Accounts

You must be at least 18 years old to create an account. The Platform is designed for children aged 3–14, but all accounts must be created and managed by a parent or legal guardian. By creating an account and adding a child profile, you represent and warrant that you are the parent or legal guardian of the child and you consent to the collection and processing of their data as described in our Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, including your child's activity. You must notify us immediately at support@nalandaarchives.com if you believe your account has been compromised.

3. The Service

Nalanda Archives provides AI-powered personalised stories based on Indian mythology and traditions for children ages 3–14. Content is generated using artificial intelligence (Anthropic's Claude) and is educational in nature. We also offer printed books via print-on-demand fulfillment.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4. Free Trial & Subscriptions

New accounts are eligible for a 7-day free trial of the paid plan. You will not be charged during the trial period. At the end of the trial, your plan automatically converts to a paid subscription at the then-current rate unless you cancel before the trial ends. You will receive a reminder email before the trial expires.

Paid plans are billed monthly or annually via Stripe. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then.

If the subscription price changes, you will be notified at least 30 days in advance. No prorated refunds are issued for partial billing periods on cancellation.

5. AI-Generated Content Disclaimer

Stories, illustrations, and educational content on Nalanda Archives are generated with the assistance of artificial intelligence. While we review and curate content, AI-generated material may contain inaccuracies, anachronisms, or creative interpretations that do not perfectly reflect traditional scriptural sources.

Nalanda Archives does not guarantee the historical, theological, or scriptural accuracy of AI-generated content. Our stories are creative retellings inspired by Indian mythology and are not authoritative religious or academic texts. AI-generated content should not be relied upon as a substitute for formal education, religious instruction, or parental guidance.

Nalanda Archives is not affiliated with, endorsed by, or representative of any religious organisation, temple, or spiritual authority. If you encounter any content you believe is inappropriate, inaccurate, or offensive, please report it immediately to content@nalandaarchives.com.

6. Beta Features

Some features of the Platform may be made available in a beta, preview, or early-access state. Beta features are provided "as is" without any warranty. They may be incomplete, contain bugs, or be discontinued at any time without notice. Feedback you provide on beta features may be used to improve the Platform without compensation to you.

7. Content Moderation

We apply automated and human review processes to ensure content is age-appropriate, culturally respectful, and consistent with our values. We reserve the right to remove or modify any content at our sole discretion if it violates these Terms, our content guidelines, or applicable law.

Parents may report content concerns to content@nalandaarchives.com. We commit to reviewing reports within 72 hours and taking appropriate action.

8. Refund Policy — Digital Subscriptions

Digital subscriptions are non-refundable once the billing cycle has begun. If you have not accessed any content within 7 days of your initial paid purchase (excluding the free trial period), you may request a full refund by emailing support@nalandaarchives.com.

For users in the European Union, you have a 14-day right of withdrawal. However, this right does not apply to digital content once you have accessed it, provided you consented to this waiver at the time of purchase.

9. Refund & Return Policy — Physical Books

Physical books are printed on demand by our fulfillment partner, Lulu Press, Inc. Print-on-demand books are custom-manufactured; returns for change of mind are not accepted.

You may return a physical book within 15 days of delivery if it arrives damaged, defective (missing pages, illegible text, damaged binding), or materially different from the description. To initiate a return, email support@nalandaarchives.com with your order number and photographs of the issue. A replacement or refund will be processed within 10 business days.

Shipping costs for returns due to our error are borne by us. Slight variations in colour, paper texture, and print quality are inherent to print-on-demand manufacturing and are not considered defects. Our books are printed using materials that comply with applicable safety standards for children's products.

10. Shipping Policy

Physical books are printed and shipped by Lulu Press, Inc. Nalanda Archives does not hold physical inventory. Estimated delivery times are provided at checkout and vary by destination. These are estimates and not guarantees.

Shipping charges are calculated at checkout based on destination and shipping method. For international orders, the recipient is responsible for any customs duties, import taxes, or fees imposed by the destination country.

Risk of loss and title for physical books passes to you upon delivery to the carrier. We are not responsible for delays caused by customs, postal services, or events beyond our control. Order tracking information will be provided via email once your book ships. For shipping damage, please photograph the damage and contact us within 7 days of delivery.

11. Intellectual Property & Copyright

11.1 Ownership

All content on the Platform — including but not limited to AI-generated stories, illustrations, character reference artwork, character designs, visual style systems, prompt engineering methodologies, story templates, curriculum structures, UI/UX design, source code, databases, the "Nalanda Archives" name, logo, and all associated branding — is the exclusive property of Nalanda Archives or its licensors. All rights are reserved.

11.2 Limited Licence

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform for personal, non-commercial purposes only. This licence does not include any right to:

• Reproduce, distribute, publicly display, or publicly perform any content from the Platform
• Modify, adapt, translate, or create derivative works based on Platform content
• Download, scrape, crawl, or systematically extract content through any automated means
• Use any content to train, fine-tune, or develop artificial intelligence or machine learning models
• Frame, mirror, or embed Platform content on any other website or application
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Sell, resell, licence, sublicence, rent, lease, or otherwise commercially exploit any content
• Use Platform content in any competing product or service

For purchased physical books only: you may read and share the physical book for personal, non-commercial use. You may not scan, digitise, photograph, or reproduce the book's contents in any format.

11.3 Public Domain Sources

The mythological narratives retold on this Platform are drawn from ancient texts in the public domain (including the Ramayana, Mahabharata, Puranas, Panchatantra, Jain Agamas, and others). Our intellectual property claim extends to our specific creative expression — our unique retellings, adaptations, visual interpretations, character designs, illustration styles, prompt engineering, story structures, and technological implementation — not to the underlying mythological narratives themselves.

11.4 Trademarks

"Nalanda Archives", the Nalanda Archives logo, "Bodhi Vriksha", and all associated names, slogans, product names, and visual identities are trademarks or service marks of Nalanda Archives. You may not use these marks without our prior written consent.

11.5 Copyright Infringement & DMCA

If you believe that any content on the Platform infringes your copyright, please submit a notice to copyright@nalandaarchives.com including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material; (c) your contact information; (d) a statement of good-faith belief; (e) a statement under penalty of perjury; and (f) your signature.

11.6 Enforcement

Any unauthorised use of Platform content constitutes a material breach of these Terms and may violate copyright, trademark, and other applicable laws. We reserve the right to pursue all available remedies including immediate account termination, injunctive relief, and recovery of damages and legal costs.

11.7 User Feedback & Submissions

By submitting feedback, suggestions, or ideas to us, you grant Nalanda Archives a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, modify, and incorporate such content without any obligation of compensation or attribution.

12. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Platform
• Interfere with or disrupt the Platform's infrastructure
• Use automated tools (bots, scrapers, crawlers) to access the Platform
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use the Platform to train AI or machine learning models
• Share your account credentials with third parties
• Create multiple accounts to circumvent subscription limits or free trial eligibility
• Use the Platform in any way that could harm, abuse, or exploit children

13. Account Suspension & Termination

We reserve the right to suspend or terminate your account, without notice and without refund, if we believe you have: (a) violated these Terms; (b) provided false information; (c) engaged in fraudulent or abusive activity; or (d) posed a risk to the safety of children on the Platform. Termination does not affect any rights or obligations that arose before the termination date.

You may close your account at any time through account settings. Upon closure, your access to the Platform and any stored content will cease. See our Privacy Policy for how we handle your data after account closure.

14. Chargeback Policy

If you initiate a chargeback or payment dispute with your bank or card issuer, we reserve the right to immediately suspend your account pending resolution. Chargebacks that we determine to be fraudulent or in bad faith — including chargebacks filed after accessing substantial content, after the free trial, or after using a purchased book — may result in permanent account termination.

We strongly encourage you to contact us at support@nalandaarchives.com before initiating a dispute, as we are able to resolve most issues more quickly than the chargeback process.

15. Third-Party Services

The Platform integrates with third-party services including Clerk (authentication), Stripe (payments), Anthropic (AI story generation), Fal.ai (image generation), Cloudflare (CDN and security), Vercel (hosting), Fly.io (backend), Resend (email), and Lulu Press (book printing). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

16. Data Retention

We retain your account data while your account is active. Upon account deletion, personal data is permanently removed within 30 days. Anonymised, aggregated data may be retained for product improvement. Payment records are retained as required by applicable tax and accounting law. 17. Indemnification

You agree to indemnify, defend, and hold harmless Nalanda Archives, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your child's use of the Platform under your account.

18. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NALANDA ARCHIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIVE HUNDRED INDIAN RUPEES (₹500).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct.

20. Force Majeure

Neither party shall be liable for any failure or delay in performance due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, civil unrest, government actions, internet or telecommunications outages, power failures, or third-party service outages. This section does not apply to payment obligations.

21. Export Controls

The Platform may be subject to export control laws and regulations of India, the United States, and other applicable jurisdictions. You agree not to use, export, re-export, or transfer the Platform or its content in violation of any applicable export control laws. By using the Platform, you represent that you are not located in a country subject to trade sanctions and that you are not on any government denied-parties list.

22. Accessibility

We are committed to making Nalanda Archives accessible to users with disabilities. If you experience any accessibility barriers on the Platform, please contact us at hello@nalandaarchives.com and we will work to address the issue.

23. Dispute Resolution & Arbitration

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation for a period of thirty (30) days from the date of written notice.

If the dispute is not resolved through negotiation, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Ahmedabad, Gujarat. The language of arbitration shall be English. The arbitral tribunal shall consist of a sole arbitrator.

US Users — 30-day opt-out: If you are a resident of the United States, you may opt out of the arbitration agreement within 30 days of first accepting these Terms by emailing legal@nalandaarchives.com with the subject "Arbitration Opt-Out." If you opt out, disputes shall be resolved in the courts of competent jurisdiction in your state.

Nothing in this section shall prevent any party from seeking injunctive or equitable relief. For Indian consumers, nothing herein limits your right to approach the appropriate Consumer Disputes Redressal Commission.

24. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Subject to the arbitration clause above, the courts of Ahmedabad, Gujarat, India shall have exclusive jurisdiction.

25. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nalanda Archives regarding the Platform.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

No Waiver: Failure to enforce any right under these Terms shall not constitute a waiver of that right.

Assignment: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger or acquisition.

Survival: Sections on Intellectual Property, Indemnification, Disclaimer of Warranties, Limitation of Liability, Dispute Resolution, and any other provisions by their nature survive termination of these Terms.

26. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days in advance. Continued use of the Platform after the effective date of changes constitutes acceptance. If you disagree with the revised Terms, your sole remedy is to discontinue use of the Platform and close your account.

27. Grievance Redressal Officer

In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer:
